1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the KinLamp mobile application, related websites, and services (collectively, the “Service”) operated by KinLamp (“we,” “us,” or “our”). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
KinLamp is intended for users aged twelve (12) and older. If you are under the age of legal majority in your jurisdiction, you may use the Service only with consent and supervision of a parent or legal guardian. By using KinLamp, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms (or that your parent or guardian has accepted these Terms on your behalf).
3. Description of the Service
KinLamp is a spatial light telemetry and cyber readout dashboard application designed for ambient awareness, self-reflection, education, and entertainment only. The Service provides light-environment scans (Lux and correlated color temperature), spatial cabins in a space library, optional scene attachments, readout encyclopedia content, and optional AI interpretation text.
Content Use Disclaimer. All content provided through the Service—including scan readouts, tuning suggestions, encyclopedia entries, spatial focus prompts, and AI interpretation text—is offered for environmental awareness, reflection, and everyday mindfulness only. Readings are algorithmic estimates, not certified laboratory measurement. They do not constitute medical advice, psychological diagnosis, clinical treatment, or professional financial or legal guidance.
Important — Not Professional Advice. KinLamp does not provide fortune-telling, astrology, tarot reading, investment, trading, legal, medical, psychological, or therapeutic advice. Any numbers, scan results, scene prompts, or AI-generated text within the app are produced for reflective, educational, and entertainment use only — not as predictions of future events. You must not rely on the Service for decisions involving money, health, relationships, compliance, or any matter requiring licensed professional judgment.
4. How Results Are Generated
Light-environment scans combine on-device sensor sampling with backend algorithms to estimate illuminance (Lux) and correlated color temperature (CCT). Spatial focus outputs may use deterministic and pseudo-random processes with user-selected parameters (such as birth month/year, local time, and optional location context). These outputs are mindfulness and reflection prompts, not predictions of future events or guaranteed outcomes.
5. AI-Generated Content Disclaimer
Certain pass-tier features may invoke third-party Large Language Models (“LLMs”) to produce AI interpretation text framed as readout context, cognitive reflection, and ambient awareness guidance. Such content is generated automatically and may be incomplete, inaccurate, inconsistent, culturally insensitive, or otherwise objectionable.
- We do not guarantee the accuracy, completeness, or suitability of AI-generated text.
- We are not responsible for AI “hallucinations,” errors, or offensive material produced by external models.
- AI output is provided “as is” for entertainment and reflection only and must not be treated as factual or advisory.
6. Account, Device, and Acceptable Use
You agree to:
- Provide accurate information where requested and keep your credentials secure.
- Use the Service only for lawful personal, non-commercial purposes unless we authorize otherwise.
- Not reverse engineer, scrape, interfere with, or misuse the Service or its infrastructure.
- Not use the Service in any way that violates applicable law or third-party rights.
7. In-App Purchases and Space Library Passes
Paid offerings and space library passes available within KinLamp are processed entirely through the Apple App Store ecosystem. Apple handles payment collection, billing receipts, and applicable taxes.
- Purchases typically unlock a time-limited space library, readout encyclopedia access, and AI interpretation quota as displayed in-app on each product before purchase. Duration follows the specific product you select — not a fixed term stated on this website.
- Unless explicitly stated otherwise in-app, passes are one-time purchases and do not auto-renew. You may purchase again before expiry to extend access.
- All purchases are subject to Apple’s standard Licensed Application End User License Agreement (EULA) and App Store terms.
- Unless required by applicable law or Apple policy, all purchases are final and non-refundable through us.
- Refund requests must be directed to Apple Support in accordance with Apple’s policies.
- Pass durations, tier benefits, and pricing are displayed in-app before purchase and may change with notice where required.
8. Intellectual Property
The Service, including software, visuals, audio, text, trademarks, and design elements, is owned by KinLamp or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service as intended. You may not copy, modify, distribute, or create derivative works except as permitted by law.
9. Privacy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINLAMP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE THROUGH THE APP STORE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS (US $50), WHICHEVER IS LESS.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless KinLamp and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.
13. Termination
We may suspend or terminate access to the Service at any time if you breach these Terms or if continued operation is impractical. You may stop using the Service at any time. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will survive.
14. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which KinLamp is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply. Any dispute shall be resolved in the competent courts of that jurisdiction, unless applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the effective date above and, where appropriate, through in-app notice. Continued use after changes become effective constitutes acceptance of the revised Terms.
